This agreement is made effective as of TODAY by and between:
Recipient: You – As Identified with Your First and Last Name (Below) Vehicle: Entered by You (Below) Provider: Colibri EV, LLC, located at PO Box 14111, Scottsdale, Arizona 85267
1. Description of Services:
Colibri EV, LLC will provide the following services (the “Services”):
Charging of electric vehicle(s).
2. Payment:
A Non-Refundable Payment of $150 will be made now to Colibri EV, LLC upon execution of this Contract, to confirm your appointment. If cancellation occurs while in route, this payment will be kept.
In addition to this payment, you will be billed for charging time upon completion of services.
3. Term:
This Contract will terminate automatically upon completion of the Services required by this Contract.
4. Hold Harmless Agreement:
Provider agrees to indemnify and hold Recipient harmless from all claims, losses, expenses, fees, including attorney fees, costs, and judgments that may arise from the acts or omissions of Provider and/or Provider’s employees, agents, or representatives.
5. Release of Liability:
Recipient acknowledges the risks associated with electric vehicle charging and releases Colibri EV, LLC from any liability arising from the use of their facilities.
6. Dispute Resolution:
Any disputes arising out of or relating to this Agreement will be resolved through friendly negotiations. If not resolved within 30 days, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association.
7. Governing Law:
This Contract shall be governed by the laws of the State of Arizona.
8. Notice:
Any notices required under this Contract shall be sufficiently given if delivered in person or by certified mail to the address provided.
9. Entire Agreement:
This Contract contains the entire agreement between the parties, superseding any prior agreements, whether oral or written.
10. Execution:
SUBMITTED DIGITALLY – BY COMPLETING YOUR SIGNATURE BELOW, the parties hereto have caused this Agreement to be executed by their duly authorized representatives as of today’s date.
Terms of Services
I have been advised that my vehicle may be damaged due to Field Exposure – Wireless charging is accomplished through a coupling of the primary and secondary coils. This involves the generation of electrical and magnetic fields that can be potentially dangerous to the user or others in the vicinity of the vehicle while charging.
I recognize the difficulty involved and I agree not to hold Colibriev EV, LLC responsible for any damage.
Our Colibriev EV, LLC service/Charging session use a Fail-Safe Charging System.
